Collective Bargaining Agreement (CBA)

The NEC now has a comprehensive CBA that was published in S.I 93 of 2019 which substituted S.I 58 of 2014. The new CBA has grades for all non managerial positions in the industry and each job grade has a minimum basic rate of pay.

One of the key features of the CBA is the inclusion of gratuities for employees who have served for at least 3 continuous years and not compulsory where the employer has a pension scheme for its employees. Also included in the CBA is the industry’s Code of Conduct that prevails over the S.I 15 of 2006 that has been in extensive use. Where institutions have been using their

internal codes of conduct, they are now required to use the NEC Code of Conduct until they have their codes ratified by the NEC for compliance with the industry’s code, Labour Act and constitution of Zimbabwe.

All employers in the Private Medical Industry are therefore required to register with NEC and to abide by the provisions of the CBA in terms of Section 2 of the CBA as read with Section 80 of the Labour Act Chapter 28:01. The CBA provides the minimum conditions of service and those employers who are in a position to do better are

encouraged to do so. However, employers facing operational challenges and viability problems can apply for exemption and waiver in line with Section (6) of the CBA in the interests of business continuity.

In terms of Section (7) on Registration and Dues the monthly contributions are 2% shared equally between employer and employee with effect from 1 May 2019. These contributions enable the Council to carry out its statutory mandate. Please adhere to the provisions of the CBA for harmonious employer-employee relationships.
